A Discussion of Two Topics Important to Professional Conduct

This Professional Conduct CLE seminar is being held on Friday, December 19, 2014 from 12:00 p.m.  to 2:30 p.m.

Summary of Program
 


The first part of this program provides an overview aimed for use by service providers in the legal profession (lawyers, paralegals, investigators, mitigation experts, etc.) of what it means to have a client who is addicted to a chemical substance.  In other words, what do those in the legal profession need to know to better understand the science behind addiction and substance abuse in order to better represent that client? This presentation is geared specifically to those in the legal profession who often deal with the chemically dependent or the chemically addicted.  The goal is to improve representation of those clients by enhancing the professional’s understanding from a medical perspective of the problems associated with substance abuse and addiction.

The second part of this program discusses the difficulties presented to lawyers when in the practice of law they cannot exercise their First Amendment rights as freely as they wish given the ethical restrictions on those rights.  Considerable case law has developed in this area, but the law leaves us with the question of whether practicing lawyers bound by their particular jurisdiction’s ethical rules have any First Amendment rights left. This part of the program will examine the law particularly of Ohio in formulating an answer to this question.
